Terms of Service

These Terms of Service ("Terms") govern your use of evictionusa.org and any related services provided by Eviction USA ("the Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Eviction USA is not a law firm and does not provide legal advice. The notices we generate are self-help templates based on Florida Statutes Chapter 83. Use of our service does not create an attorney-client relationship. For complex situations or representation in court, consult a licensed Florida attorney.

1. Introduction

These Terms form a binding agreement between you and Eviction USA. They apply to all visitors and users of evictionusa.org. If you are using the Service on behalf of a company, partnership, LLC, or trust, you represent that you have the authority to bind that entity to these Terms.

2. The service

Eviction USA provides:

  • A self-service tool that generates Florida-statute-compliant eviction notice templates (3-Day, 7-Day, and 15-Day notices) by inserting your factual information into pre-built statutory forms
  • A referral service connecting Florida residential landlords with independent eviction attorneys, process servers, and eviction services in our partner network
  • Educational content about Florida landlord-tenant law and the Miami-Dade eviction process

3. Eviction USA is not a law firm

Eviction USA is not a law firm and does not provide legal advice, legal representation, or legal opinions. We operate as a scrivener service: we fill in your factual information into pre-built statutory templates. We do not draft custom legal language for your situation, recommend legal strategies, evaluate the merits of your case, or represent you before any court or administrative body.

4. No attorney-client relationship

Communicating with us through the Service, submitting your information through our form, viewing our content, or using the templates we generate does not create an attorney-client relationship between you and Eviction USA. Information you submit to us through the Service is not protected by attorney-client privilege.

5. Specialist referrals

We may refer you to independent Florida-licensed eviction attorneys, process servers, and eviction services ("Specialists"). Specialists are not employees, agents, or partners of Eviction USA. Their advice and services are their own. Any attorney-client or service relationship you establish with a Specialist is between you and that Specialist.

We may receive compensation from Specialists for referrals. This compensation does not increase the price you pay. You are free to decline any referral and choose your own representation.

6. Your responsibilities

You agree to:

  • Provide accurate, complete, and current information when using the Service
  • Use the Service only for lawful eviction matters in which you are the landlord or authorized agent
  • Not use the Service to harass, intimidate, defraud, or violate the rights of any tenant or other person
  • Verify the legal sufficiency of any document we generate with a licensed Florida attorney before serving it on a tenant or filing it in court, especially if your situation has any complicating factors (e.g., LLC ownership, Section 8 tenancy, fixed-term lease still in effect, mobile home parks, condo HOA involvement)
  • Not attempt to circumvent any technical restrictions or security measures
  • Not scrape, harvest, or otherwise extract our content for resale

You are solely responsible for verifying that any notice or document is legally sufficient for your specific situation before serving or filing it.

7. Document templates

The notice templates we generate are based on Florida Statutes § 83.56 (3-Day, 7-Day with cure, 7-Day without cure) and § 83.57 (15-Day) as in effect on the date listed on each template. Statutes change. Court rules change. Local procedures change. You are responsible for verifying that any template is current and applicable to your specific situation before relying on it.

We make no warranty that a template will be accepted by any particular court or judicial officer or that it will achieve any particular outcome.

8. No warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

  • The notices or documents we generate will achieve any particular outcome
  • The Service will be uninterrupted, secure, error-free, or free of harmful components
  • The information on the Service is accurate, complete, or current at all times
  • Any defects in the Service will be corrected

9. Limitation of liability

To the maximum extent permitted by law, Eviction USA, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or use, whether incurred directly or indirectly, arising from or related to your use of the Service or any documents, information, or referrals obtained through the Service.

Our total aggregate liability to you for any claim arising from or related to the Service shall not exceed one hundred U.S. dollars ($100).

10. Intellectual property

All content on the Service — including text, designs, logos, software, and document templates — is owned by Eviction USA or its licensors and is protected by copyright, trademark, and other applicable laws. You may use the templates we generate solely for your own legitimate eviction matter. You may not redistribute, resell, sublicense, republish, or create derivative works from our content for commercial purposes without our prior written consent.

11. User submissions

By submitting information through our form or otherwise communicating with us, you grant Eviction USA a worldwide, non-exclusive, royalty-free license to use, store, process, and share that information solely as necessary to provide the Service, including with Specialists per Section 5 of these Terms and Section 4 of our Privacy Policy.

12. Modifications

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be communicated via prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing law

These Terms and any dispute arising from them or your use of the Service are governed by the laws of the State of Florida, without regard to conflict-of-law principles. The exclusive jurisdiction and venue for any judicial proceedings is the state and federal courts located in Miami-Dade County, Florida.

14. Dispute resolution

Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Miami-Dade County, Florida.

You and Eviction USA waive any right to a jury trial and to participate in a class action, class arbitration, or representative action.

15. Severability

If any provision of these Terms is found by a court or arbitrator to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be enforced to the maximum extent permitted by law.
